MobiTog provides the leading web based community dedicated to Mobile Photography with the iPhone and iDevices. We welcome anyone who enjoys taking pictures with their iPhone, iTouch or iPad!
The community is for image sharing, comments and crit, and for meeting people all over the world. The MobiTog App allows users full access to the MobiTog forum from their iPhones, iTouch and iPads.
MobiTog provides a unique forum covering all aspects of iPhoneography and encouraging new users and proficient, even professional, iPhoneographers to join the iPhone for photography revolution at MobiTog.
MobiTog provides a free, web based community forum where iPhoneographers may share their images, discuss iPhotographs and all aspects of their art form and experiences in iPhone Photography with like-minded artists.
The main aim of MobiTog is to promote and encourage the taking and sharing of quality images taken with an iPhone, in the art form universally known as iPhoneography, and encourage a serious, but easy and fun, way to enjoy taking and sharing photographs and discussing all aspects of iPhoneography.
Terms and Conditions
The following Terms and Conditions (Rules) will apply to you when using MobiTog.com (MobiTog).
You agree to accept and be bound by these terms and conditions as set out below. By posting on the forums, you are deemed to have accepted these terms and agree to be bound by them. Should you reject the terms and conditions and not wish to be bound by them, then use of the MobiTog website is prohibited to you.
We may update the Rules from time to time without any notice to You. In addition to the following Rules, You agree also to be bound by any guidelines or announcements made during your membership of MobiTog. Additionally, when using particular sections of MobiTog, you shall be subject to any posted guidelines, or rules, applicable to such services as may be posted from time to time. All such guidelines, or rules, are hereby incorporated by reference into the Terms and Conditions.
Neither the owners, administrators, moderators nor members will be held responsible for any advice, given freely, on the forums.
These definitions shall apply to the following terms and conditions in their entirety.
The term “you” or “your” within these terms and conditions shall be accepted to refer to you, the member/user of MobiTog. The term “we” or “us” or “MobiTog” refers to the MobiTog web site (located at www.mobitog.com) and includes its members. The term “Registration Information” refers to any and all information provided by you to us. The term “Member” refers to the members of MobiTog either individually or as a group. The term “Content” refers to, but is not confined to, text, links or images found within this web site. The term “Confidential” refers to any and all information not available to the general public.
2. Acceptable Behaviour
Your use of MobiTog shall be in accordance with these terms and conditions, which are non-negotiable.
You agree you will not:
A. Post, transmit, upload, email or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships, such as for example, inside information, confidential or proprietary information gained or disclosed as a part of employment relationships, or under agreements of nondisclosure;
B. Post, transmit, upload, email or otherwise make available any content that in doing so infringes a trademark, patent, copyright, trade secret or other proprietary rights of any party;
C. Post, transmit, upload, email or otherwise make available any material that contains software viruses, computer code, programs or files designed to interrupt, limit the functionality of, or destroy any computer hardware or software, or telecommunications equipment;
D. Post, transmit, upload, email or otherwise make available any content that is illegal, abusive, harassing, defamatory, confidential, harmful, threatening, vulgar, libellous, invasive of another’s privacy, or ethnically, racially or otherwise objectionable;
E. Impersonate any person or entity. This includes but is not limited to, any MobiTog team member or administrator, any employee of any company, or falsely state or otherwise misrepresent your affiliation with another person or entity;
F. Manipulate or forge headers or identifiers with the intention of disguising the origin of any content that you provide to the web site;
G. Register or post in excess of one account with us. Should it come to our attention that you have registered more than one account, we may remove your posting rights, therefore prohibiting your participation on MobiTog;
H. Discuss any other forum member or website in anything but a positive light.
3. Forum Use
This section governs use of the discussion forum and applies to all users either directly or indirectly, registered or otherwise.
You agree you will not:
A. Provoke others or cause trouble. If you wish to argue with people then go to instant messenger or email;
B. Make personal attacks on anyone during your use of the forum. Do not abuse someone for example, because of their race, colour, sex, or religious beliefs;
C. Reignite inflammatory threads by creating new threads after existing threads on the same topic have been closed;
D. Use bad language. MobiTog has a “swear filter” built in, but if you do wish to use a swear word; please check your post afterwards to ensure your word has been censored. If you do not, you may receive an infraction for swearing;
E. Attempt to take threads off-topic or make off-topic posts within threads. Off topic posts may be removed at our discretion. The section marked as a designated “Members Area - Off Topic Chat” area is more relaxed on off-topic posts;
F. Argue a moderators decision publicly. Any and all complaints directed at a moderating decision should first be addressed to the moderator in question via private message. If the problem cannot be resolved, then you may ask that your complaint be referred to the other moderators to make a joint decision. This decision will be final;
G. Reproduce messages sent using the forum Private Messaging function on the forum, or anywhere else, without permission from the sender, unless you need to report it for breaking the rules, causing offence, or if requested to by an administrator for site administration purposes;
H. Have a signature larger than 600px wide by 100px high. If your signature is larger than the allocated size, you will be requested by a moderator to re-size your image. Failing to amend your signature when requested to by a member of our staff will result in the removal of your signature. Signatures may not contain adverts of any sort unless previously agreed by us. Please also keep text signatures under 4 lines;
I. Provide links to third party web sites or content unless given express permission to do so by a moderator or administrator. The exception to this condition are, links shown to be relevant to any discussion taking place will be permitted within the context of that discussion. We may remove third party links at any time with or without explanation.
A. We may, for content management purposes, move a forum thread to a more appropriate forum area if we feel that it is situated in an incorrect forum area;
B. We may, for content management purposes, close a thread. This would, usually, be because the discussion in the thread is not moving along, users are not covering new points, or the discussion is going around in circles. We would also consider whether the discussion is interesting or motivates participation in the context of the forum subject matter;
C. We may use an infraction system to warn of inappropriate conduct. Infractions attach points to user’s accounts and expire after a set time period. The points used and time limits vary with the offence severity. Accounts will be suspended if the total current points reaches or exceeds 5 and will only be restored after expiry of sufficient points to drop the total below this limit;
D. When an infraction is issued, or an account is suspended you may private message (PM) the team to clarify the matter if you wish. If appropriate, your comments will be reviewed by team member(s) independent of the original infraction. Removal or alteration of the infraction will only be considered if, in the opinion of the reviewer, a clear mistake occurred. Infractions over 28 days old will not be removed or altered for any reason. Abusive PMs to the team may attract a longer suspension or even a permanent ban. We reserve the right to permanently ban spammers and persistent troublemakers;
MobiTog is a UK based, English speaking forum, unless you receive prior permission, all posts, articles, signatures or other submissions should be made in English. This is so we may verify their meaning.
5. Third Party web sites
You accept we cannot be held responsible for any third party web sites you may access through MobiTog and further agree any third party content is not our responsibility. We do not endorse any third party web sites or content unless clearly stated and therefore cannot be held liable or responsible for any promotion, content, service or product located on a third party web site. We further cannot be held liable or responsible for any loss or damage or offence that may be caused, or that you allege has been caused by third party content or Web sites.
All and any contact that you have with third party traders or websites you may come into contact with during your use of MobiTog, including but not limited to payments for products or services, any conditions made, warranties offered, or contracts entered into, are your responsibility and not the responsibility of MobiTog.
6. Our Rights
You acknowledge and accept the MobiTog site contains a large and varied content. We do not check content posted by you prior to it being placed on the web site. We therefore reserve the right to remove or delete in part or in its entirety any content you submit, should we feel it violate these terms and conditions, any guidelines or announcements that may be available to view elsewhere on MobiTog, or the general ethos of the site.
You acknowledge and accept we are neither liable nor responsible for the content you submit. We will monitor such content as appropriate and act accordingly should we be informed of any objectionable material. We do not actively monitor PM’s sent to and from members having access to the PM system.
Each member has approximately 1 week to edit a post from the time submitted. After this time, posts cannot be altered or removed. You may submit a request to the webmaster, or site moderators, to edit or delete your post after the day has elapsed. We will not however, be under any obligation to accept requests to edit or delete a post or a significant amount or all your posts in their entirety. We do not delete accounts - and you acknowledge and accept we are under no obligation to edit or delete all your posts submitted on the site.
You acknowledge and accept that we have the right to temporarily or permanently remove your ability to post content, and that we further have the right to ban you from the MobiTog should you break any of these Terms and Conditions.
You acknowledge the owners of MobiTog cannot be held responsible for any content posted on the site, and further you absolve the owners of all legal responsibilities for any content you find offensive, distasteful, or that potentially breaks and laws in England and Wales. Any content you find offensive, unacceptable or illegal should be reported using the Report Post or Report PM button on every post or PM on the forum. If you do not report it, you are deemed to have found the content acceptable and legal. Not every post on the forums is monitored and thus we cannot guarantee every post will be in accordance with these terms and conditions. However, once such a matter is brought to our attention, we will deal with it forthwith.
You acknowledge and accept that, in certain circumstances, we have the right to provide information to your ISP, at our discretion, following but not limited to severe disruption by you, the provision of illegal or abusive content, any attempts made by you to re-register after being banned, or for any other reason that involves you breaking these Terms and Conditions.
You acknowledge that, reproduction of material from this web site without prior written permission is strictly prohibited. All contributions to this site remain Copyright of the original owner.
You acknowledge and accept that if you are banned from use of the MobiTog web site, you will not in any way attempt to re-register using any other name or identity not known to us, or any other email address not known to us. If you do so, we will pursue the maximum penalty available under your Internet Service Provider's Acceptable Use Policy.
You remain solely responsible for the content of your posted messages. Furthermore, you agree to indemnify and hold harmless the owners of this forum, any related websites to this forum, its staff, and its subsidiaries. The owners of this forum also reserve the right to reveal your identity (or any other related information collected on this service) in the event of a formal complaint or legal action arising from any situation caused by your use of this forum.
You have the ability, as you register, to choose your username. We advise that you keep the name appropriate. With this user account you are about to register, you agree to never give your password out to another person except an administrator, for your protection and for validity reasons. You also agree to NEVER use another person's account for any reason. We also HIGHLY recommend you use a complex and unique password for your account, to prevent account theft.
After you register and login to this forum, you will be able to fill out a detailed profile. It is your responsibility to present clean and accurate information. Any information the forum owner or staff determines to be inaccurate or vulgar in nature will be removed, with or without prior notice. Appropriate sanctions may be applicable.
Please note that with each post, your IP address is recorded, in the event that you are banned from this forum or your ISP contacted. This will only happen in the event of a major violation of this agreement.
Also note that the software places a cookie, a text file containing bits of information (such as your username and password), in your browser's cache. This is ONLY used to keep you logged in/out. The software does not collect or send any other form of information to your computer.
